概括式不可抗力条款

国际货物买卖合同中不可抗力条款的一种订定方式。

其特点是：在条款中仅笼统地提“由于不可抗力的原因”一句话，对于不可抗力的具体事件则不作叙述，进而申明对不可抗力造成的后果，不承担责任，继而再说明不可抗力发生后通知对方的时间和方式，以及提供出具证实不可抗力事件发生之证明的机构等。条款实例如下：“由于不可抗力的原因，致使卖方不能全部或部分装运或延迟装运合同货物，卖方对于这种不能装运或迟缓装运本合同货物不负有责任。但卖方须用电报或电传通知买方，并须在15天内以航空挂号信件向买方提交由中国国际贸易促进委员会出具的证明此类事故的证明书。”(If the shipment of

the contracted goods is prevented or delayed in whole or in part due to Force Majeure，the Seller shall not be liable for nonshipment or late shipment of the goods of this contract. However，the Seller shall notify the Buyer by cable or telex and furnish the latter within 15 days by registered airmail with a certificate issued by the China Council for the Promotion of International Trade attesting such event or events．)
